Real Estate in The Commonwealth of the Northern Marianas Islands

The Commonwealth of the Northern Mariana Islands (CNMI) consists of thirteen islands of which Saipan, Rota and Tinian are mainly known. In the CNMI, there are two types of properties, the private and the public. Private properties are mainly owned by individuals while the public properties are handled by the CNMI Government, The Department of Public Lands. Currently, private properties can only be owned by the Northern Mariana Descents but can be leased by non Northern Mariana Descents for a maximum of 55 years and the public properties can be leased for a maximum of 40 years. Although the physical land can not be owned by anyone other than Northern Mariana Descents, a condominium located on private property only and is second floor and above can be out right owned by anyone.

If your are searching for private property, there are somethings you should keep in mind. After finding a private property, you should always have a title search conducted on the property. There are two reputable companies in Saipan which performs property title searches for a fee depending on what type of title search you request. Why a title search? This will give you a history of the property such as who is the simple fee owner and who is the current lease holder if any. An example of a title search is a commitment for title insurance which will tell you what the title company will not insure if you decide to purchase the property and have it insured. Thereby, giving the buyer a very good idea on whether the title to the property is clear and free or there are problems which needs to be addressed. The next step should be an attorney. Have an attorney look over the title report and draft out a lease agreement to protect you. Trying to save a few bucks might end up costing you a lot more. Remember, it is always in your best interest to seek an advice of an attorney before entering into any type of a lease agreement.

With the implementation of the new Saipan Zoning Law which took effect on February 1, 2008, a buyer has to be aware of the what zoning area the property falls under. For example, if you found a property in Dandan village which majority of the property falls under either Village Residential (VR) or Rural (RU) and you wanted to build a commercial building, you would not be able to obtain a zoning permit. Furthermore, different types of businesses fall under different zoning districts thereby a person must know what district their business is permit. Not knowing the zoning districts could be financially costly.
